Without a will, you don't have control over the distribution of property and assets after you pass away. You also won't be able to determine who cares for your children. If you don't have a will, the state determines who is entitled to your property and assets by means of “intestate succession.” This statute distributes your estate to your spouse and children or to relatives. If you don't have any relatives, your property and assets will likely go to the state. Seventy percent of us don’t have a will!
Probate is the legal process determining the distribution of property and assets after someone passes away. This can be determined by a will, or if none exist, then the laws of intestacy determine the hierarchy of heirs. Probate law is a complex field and often requires a lawyer's guidance.
A trust is a legal means of ensuring a decedent's property and assets are transferred to heirs according to the decedent's wishes. A trust ensures more privacy than a will because it does not go through the court (probate) system. The distribution of a trust is quicker than that of a will and the terms of a living trust are not publicly disclosed to the public as with a will.
